How Long Does Traffic Citation Stay on Record in Georgia?

William C. Head, PC

Georgia drivers who ask how long does traffic citation stay on record are hoping for a date when the entry disappears. A traffic conviction stays on the certified driving history kept by the Georgia Department of Driver Services (DDS) permanently. What changes is the point count: those points stop counting against your license after 24 months. A DUI, OCGA § 40-6-391, is different again. It is a criminal conviction, it is not eligible for record restriction, and it does not come off at all. A reckless driving conviction taken as a reduction from a DUI charge is just as permanent. Atlanta DUI lawyer William C. Head has explained Georgia DUI laws to non-lawyers since 1991.

The 12 Most Common Questions Asked of Our Criminal Defense Attorneys (FAQs)

  1. Should I have taken the breathalyzer test after my arrest for DUI? All states have been "encouraged" to enact implied consent laws that suspend a driver's ability to drive if he or she refuses to submit to the breathalyzer or blood test requested by police, after the DUI arrest. In Georgia, that total license suspension is for 12 full months. I also read online that I can install and pay for an ignition interlock device for 12 months. Is that wise to do, or should I file a DDS GA appeal? Yes, if you are an eligible Georgia licensee. This is a very important issue to go over with our experienced attorneys, during your no-cost free consultation.

  2. What does DUI mean? My traffic citation for driving under the influence has the notation for the statute, OCGA § 40-6-391. The other traffic tickets have different citation numbers and code sections. The traffic ticket is the accusation against you. Each new motor vehicle charge should have a different code section. What does DWI stand for? Either driving while intoxicated (TX) or driving while impaired (NC).

  3. The law enforcement officer never saw me driving a moving vehicle. Does this mean I cannot be convicted? Our GA laws changed over 30 years ago to cover actual physical control. If you were in the driver's seat, and have the key (fob, or other means to start the vehicle), you may be charged with D.U.I.

  4. For the best lawyers near me in Atlanta GA, how much does a DUI lawyer cost? Fees are set by each law office. Generally, the best lawyers will be charging more, due to how they approach each case, and their track records for success. The purpose of the free lawyer consultation is to explain all that will be done to help you win.

  5. For drunk driving, I have heard of both DUI and DWI. What does DUI stand for and what does DWI mean? These are just two of over a dozen different acronyms for driving impaired.

  6. On a 2nd DUI in GA, I read a website written by lawyers for DUI near me that says that I could lose your right to drive for 120 days. Is that true? If convicted, yes. If your second offense DUI is reduced to a lesser crime (e.g., reckless driving GA) then you avoid this mandatory loss of driving privileges.

  7. My case is pending in the Atlanta Traffic Court located at 150 Garnett Street. Should I demand a jury trial and move the case over to Fulton County State Court? No, don't do that. This court has fair prosecutors that may offer you a favorable outcome, if you have legal counsel that has found flaws in the arrest, testing and/or booking process.

  8. Would going ahead and taking the DUI school course early help my cause, or be a wise move for me to make? It cannot hurt you and may help you. In some of our courts, it is very highly valued to be proactive like this.

  9. If I submitted to the post-arrest blood alcohol test, will that sample also be tested for marijuana? Good question. Usually, if your blood alcohol level is over the legal limit, then the GBI won't retest for drugs. But our lawyers near me for DUI will request to have access to that blood, to look for proof of prescribed medications (e.g., zolpidem or Ambien) that may have identified a medical condition (unintentional or somnambulant driving) known as "sleep-driving."

  10. Can a nolo contendere plea keep a Georgia traffic citation off my record? No. A nolo plea is still a disposition, and the court reports it to DDS, so the citation posts to your driving history. For drivers 21 and older, a nolo plea may stop points on most traffic offenses, once every five years. It does not help on a DUI charge, where a nolo plea is treated as a conviction.

  11. Does a driver improvement course remove points from my Georgia license? A DDS-approved driver improvement course can cut your point count by up to seven points, once every five years. The course lowers points only. It does not erase the conviction entry, which stays on the driving history.

  12. I got a ticket in another state. Does it come back to my Georgia license? Often, yes. Georgia shares conviction data with most other states, so an out-of-state moving violation can be reported to DDS and posted to your Georgia record. Whether points follow depends on the offense and how DDS treats that code section.

How Can I Judge My Chances to Beat a DUI Less Safe Case in Georgia?

When a person faces a DUI alcohol less safe case in Georgia, the decision about whether the accused driver has been proven to be a less safe driver is up to the "trier of fact." This is either a jury, or a judge at a "bench trial" (if the accused citizen or his or her DUI lawyer opts to submit the guilt-innocence phase of the DUI case to a judge sitting without a jury). Because tens of thousands of Georgia DUI arrests begin their criminal court journey in a municipal court in Georgia, which is one of several non-jury, entry-level courts, the major factor is deciding on a "judge trial" over a trial by jury is the judge's reputation for fairness and being even-handed. Because the municipal court judge assigned to hear the DUI case is appointed in all municipal courts except one, some judges make their rulings based on retaining their appointment by the mayor, the city manager, or by the mayor and city council. The truth is that most accused citizens are poor judges of their chances to win a DUI case. This is because 99% of our clients have never had any kind of criminal trial, and have never watched a trial of any type, especially not a DUI less safe case. Virtually 100% have never watched a DUI trial, nor know the intricacies of GA DUI law, or have been the accused person in a DUI prosecution. Plus, a non-lawyer will have no knowledge about how to exclude field sobriety test evidence, or a breath alcohol test, based upon various legal issues surrounding these common legal issues in drunken driving cases. These factors can make a HUGE difference in any DUI case, and a seasoned, experienced DUI attorney can assess the chances of success to a reasonable degree of certainty, once he or she knows all the State's evidence.

Talk With a Georgia Traffic Ticket and DUI Defense Lawyer

A Georgia conviction does not come off the driving history. So the decision you make at the citation stage is the one that sets what your record looks like permanently. Paying the fine closes the case, and it also gives up the options a lawyer could otherwise pursue.

Our firm has defended DUI and traffic cases in metro Atlanta municipal, state, and superior courts for decades. Mr. Head wrote "101 Ways to Avoid a Drunk Driving Conviction," and he practices with Atlanta DUI attorney Cory Yager and Larry Kohn.

How Long Speeding Tickets Stay on Your Record in Georgia

Drivers who ask how long is a speeding ticket on your record are usually asking two questions at once. The conviction entry and the points behave differently.

The conviction entry does not expire. Once a Georgia court reports a speeding conviction to DDS, it stays on the certified driving history for good.

The points do fade. Under Georgia's point system, OCGA § 40-5-57, points count against your license for 24 months from the date of the offense. DDS may suspend a license that collects 15 or more points inside any 24-month window. A DDS-approved driver improvement course can cut up to seven points once every five years.

Point values depend on how fast you were clocked. Speeding 15 to 18 mph over the limit generally adds two points. From 19 to 23 mph over adds three points, 24 to 33 mph over adds four points, and 34 mph or more over adds six points. Speeding fewer than 15 mph over the limit generally carries no points, yet the conviction still posts to your record.

The same rule answers how long do driving tickets stay on your record for other moving violations, such as following too closely or an improper lane change. Insurance carriers use their own lookback windows, which the section below covers.

When Does a Speeding Ticket Go on Your Record?

The citation an officer hands you is an accusation, not a record entry. Nothing posts to your driving history until the case is disposed of. So when does a speeding ticket go on your record? The entry is created when you pay the fine, plead guilty or nolo contendere, or are convicted at trial. The court then reports that disposition to DDS, generally within days to a few weeks, depending on the court.

In our experience handling traffic and DUI cases in metro Atlanta municipal courts, drivers are often surprised that paying the fine online is treated as a guilty plea. Paying the ticket to make it go away is the act that puts it on the record. A dismissal, a nolo plea accepted in a qualifying case, or a reduction to a non-reporting charge can change what appears. So when a searcher asks does speeding ticket go on record, the accurate answer is that the disposition decides.

Stop sign tickets. Running a stop sign is a moving violation in Georgia, not a parking-type offense. So does a stop sign ticket go on your record? Yes, on conviction, and DDS generally assesses three points for failure to obey a traffic control device. The conviction entry remains after those points stop counting.

How Long Until a DUI Is off Your Record in Georgia?

Readers ask how long until a dui is off your record and expect a waiting period. Georgia does not give one for a DUI conviction. Record restriction under OCGA § 35-3-37 replaced the older expungement process, and a DUI conviction is not among the dispositions the statute makes eligible. So does a dui ever go off your record? Not once a conviction is entered.

Two separate records are in play. The Georgia Crime Information Center (GCIC) keeps the criminal history. DDS keeps the driving history. A DUI conviction sits on both, and a reckless driving conviction taken as a reduction from a DUI charge stays on the driving history too.

The distinction that matters most is conviction versus non-conviction. An arrest that ends in dismissal, nolle prosequi, or acquittal may be eligible for restriction on the criminal history side. Eligibility depends on the disposition and on the other charges in the case, so talk with a lawyer about your own arrest.

Georgia also uses a lookback window, measured from arrest dates, when deciding whether a new DUI is charged as a second or third offense. That window controls sentencing exposure. It does not mean the earlier conviction leaves your record when the window closes.

How a DUI or Traffic Conviction Affects Your Car Insurance

Your insurer does not watch the courthouse. It pulls your motor vehicle report, usually at renewal or when you apply for coverage. Many carriers look back three to five years, depending on the company and the underwriting rules it files.

That is why the two clocks run differently. The conviction stays on your Georgia driving history, while the rate surcharge tied to it commonly ages off sooner.

A Georgia DUI conviction adds another layer. Reinstating a license after a DUI suspension commonly requires an SR-22 or SR-22A certificate of financial responsibility, which the carrier files with DDS. Some carriers surcharge the policy instead. Others non-renew rather than keep the risk.

Premium increases after a DUI are frequently substantial, and they vary widely depending on driving history, coverage, and carrier. Ask your agent what your policy does at renewal, and speak with a lawyer before a disposition is entered.
