Keep Driving After Atlanta GA DUI Arrest

By: DUI Attorney William C. “Bubba” Head

Do You Need to KEEP Driving After Your DUI Arrest?

For our clients, DRIVING is absolutely essential. Particularly in metro Atlanta, a sprawling area where half of the State’s population lives, travel on the highways is critical to over 90% of our clients. So, the DUI lawyers at our firm focus their attention and negotiation efforts on the many ways to accommodate this NEED to have our clients continue driving.

First, as you will see below, you must act QUICKLY to protect your right to drive by filing your appeal in a timely manner, or waiving your right to an ALS appeal and instead electing to install an ignition interlock device on your vehicle. Second, you can attempt to file your own appeal, but attempting to handle the hearing is usually a nightmare. Third, we are adamant about the value of filing this appeal for all clients, to give you (and us) some “breathing room” while we seek to effectively handle your ALS appeal.

You need to call us in time. Don’t wait until the day before your 30-day appeal letter is due. We will help you get your appeal filed properly, and for the mere cost of the filing fee and verified delivery costs. Don’t put this off! The more time we have to gather all the evidence and file pre-trial motions to get damaging evidence excluded, the better the chance we have to beat your DUI.

Hardship license 30-day deadline after DUI arrest

Who is the Georgia attorney who wrote the book on how to avoid a DUI? The answer is Bubba Head, Atlanta’s top DUI lawyer.

Once Mr. Head signs on as your legal counsel, he immediately starts two paths of attacking the case:

  1. At the criminal court (Atlanta Municipal Court)
  2. At the administrative court (Georgia Office of State Administrative Hearings).

If we can get the criminal case resolved favorably (i.e., closing out the case but NOT putting a DUI on your record, and finding another resolution that is a non-DUI disposition), then the administrative license suspension case can also be resolved by this quick action.

Once you file an appeal, you will ultimately receive a notification from DDS that your right to drive will be extended until a hearing determines the fate of your driving privileges. The DDS Form 1205 you received after your DUI arrest is only a temporary permit to drive.
