DUI Refusal Triggers Life-Changing Problems If You Cannot Drive

Driver license suspension is the top worry for most people arrested for drunk driving in Georgia. After the arrest, the officer asks the driver to take a breath test, blood testing, or a urine test. You must know the rules for license reinstatement in Georgia. Any answer but YES usually means a DUI refusal is written up by the officer. Staying silent counts as a refusal, too, right after the officer reads you Georgia's implied consent notice.

An administrative license suspension can take away your right to drive at all. That is true under both the old and the new state DUI law. Under current law, a driver with no prior DUI conviction within five years now gets a new option. They may put an ignition interlock device (IID) on one car for a year.

Under the old Georgia implied consent law, a refusal brought harsh DUI penalties. That was true for both a second DUI and a first offense. A hard suspension meant no limited permit at all.

Now drivers who face a refusal hard suspension have a new choice. They can keep driving with an interlock in the car while they fight the case in court. The device goes on one car. The driver may then use only that car.

The IID Permit Is NOT a Full Georgia Driver's License and Can Be Lost

The IID choice gives you a special permit for the full one-year suspension. That permit can be lost. Anyone who picks the device should talk to a lawyer in Atlanta first. Do not let a default happen. A default takes away the permit and your right to drive. This is not a full license reinstatement.

Your DDS Georgia license status will show up on any license check by a police officer. That can happen at a DUI checkpoint, a routine traffic stop, or if involved in an accident. An employer, a rental car company, or a new car dealer may keep you from getting behind the wheel. These are just a few of the dozens of consequences of the IID permit.

Picking the interlock changes your Georgia license status. DDS makes you choose one path and stick with it. Talk to a DUI lawyer in Atlanta first. Your personal situation dictates what the best course of action is.

Under Georgia law, DDS revocation of an IID permit occurs for specific defaults. These include:

  • Tampering with the device. If your IID shop reports that the interlock has been tampered with, DDS must revoke the permit.
  • Failing to report for monitoring. Miss a scheduled calibration or check-in with your IID shop and DDS revokes the permit.
  • Removing the device early. If the IID comes out of your car before you finish the required monitoring term, DDS will revoke the permit.
  • Traffic violations. A conviction for any state law relating to the movement of vehicles triggers this rule. Driving in violation of your IID permit restrictions also triggers it. You must surrender the permit to the court, which forwards it to DDS within ten days.
  • Failing to complete a substance abuse treatment program. If you enrolled in a program but did not attend or finish as scheduled, DDS revokes the permit upon notice from the Department of Behavioral Health and Developmental Disabilities.

The consequences of a first-time IID permit revocation are severe. You may not apply for a driver's license for six months from the date the permit was surrendered. If your IID permit has been revoked before, you may not apply for two years.

Successfully completing the full one-year IID monitoring term opens a path back to full driving privileges. Once monitoring is complete, the IID restriction is removed. The permit may be renewed for up to two additional months. That gives you time to finish the DDS license reinstatement steps below.

License Reinstatement Georgia: How to Reinstate Your License After a Georgia DUI

A license reinstatement after a DUI in Georgia is the most common path for drivers who want to drive again. Under the new implied consent rules, the steps differ. Your path depends on whether you choose an IID or appeal the implied consent suspension.

A DUI defense lawyer can walk you through these options. An attorney explains the qualifications for reinstatement and protects your driving privileges.

Under Georgia law, the reinstatement timeline depends on how many suspensions you have had within a five-year period. Here is the general sequence:

  1. Serve the required suspension period. A first suspension runs one year, but you may apply for reinstatement not sooner than 30 days after it takes effect. A second suspension within five years runs three years, with reinstatement eligibility at 18 months. A third or subsequent suspension carries a five-year suspension period. You may apply for a probationary license after two years.
  2. Complete the DUI Alcohol or Drug Use Risk Reduction Program. Georgia law requires this class before your license can be reinstated. Most people call it "DUI School." You must get a certificate of completion from a DDS-approved provider.
  3. Obtain SR-22 insurance if required. Depending on your circumstances, Georgia may require you to file proof of financial responsibility with DDS before reinstatement. This proof is called an SR-22 form.
  4. If coming off an IID term, obtain removal certification. Your IID service provider must confirm that the device was removed after successful completion of the monitoring period.
  5. Pay the restoration fee. Under Georgia law, the restoration fee is $200.00 by mail or $210.00 in person for a first suspension. Recidivist convictions carry a higher fee of $500.00 by mail or $510.00 in person. Fee amounts are set by statute but may change. Verify with DDS.
  6. Submit all documents to DDS. You may file in person at a DDS Customer Service Center or by mail. DDS will not reinstate your license until every item is in hand.

Processing times vary. In-person visits may result in same-day reinstatement if all documents are in order. Mail-in submissions typically take longer. Allow several weeks for processing and verification.

DDS License Reinstatement: How the Georgia Department of Driver Services Handles Your Case

The Georgia Department of Driver Services (DDS) is the sole state agency authorized to suspend and reinstate driver's licenses. No court or attorney can reinstate your license directly. The reinstatement must go through DDS.

You may complete the DDS license reinstatement process in one of several ways:

  • In person at any DDS Customer Service Center. Bring a valid government-issued ID and proof that you live in Georgia. Bring the certificate from the DUI Alcohol or Drug Use Risk Reduction Program. Bring the SR-22 filing and the IID removal proof if those apply to you. A walk-in may get the license back the same day when the file is complete.
  • By mail. Send the required forms and the restoration fee to DDS. Mail-in reinstatement is available for most cases but typically takes longer.
  • Online through the DDS portal. The DDS portal handles only some cases. What you can do online depends on the type of suspension. Check the DDS website to see if yours is on the list.

The restoration fee depends on the number of prior suspensions. For a first implied-consent suspension, the fee is $200.00 by mail or $210.00 in person. This is set by Georgia law. Recidivist fees are higher. Drivers with two or more DUI convictions within ten years must also complete a clinical evaluation. If recommended, a substance abuse treatment program must be completed. DDS will then process reinstatement.

After you send the forms and the fee, check your license status on the DDS website. You can also call or visit a DDS Customer Service Center. Your license stays suspended until DDS confirms that every item is met and the restoration fee is paid.

Out-of-State Drivers Arrested for a DUI in Georgia Can Have Big Problems

At the outset, no out-of-state driver can take the interlock-restricted license option. Drivers from some states face bigger problems. Your home state may act against the license it issued based on the Georgia arrest or suspension. Do not rush the choice. Talk to an Atlanta DUI lawyer who knows these rules before you decide.
